Ascent Resources PLC has announced that it has secured an after the event (ATE) insurance policy for its €656.5 million Energy Charter Treaty damages claim against the Republic of Slovenia. The ATE insurance policy is expected to provide cover against adverse legal costs and disbursements in the event that the claim is unsuccessful. The upfront portion of the premium payable on the policy is financed through a damages-based agreement with Enyo Law LLP, with the insurer receiving a deferred contingent premium payable out of the damages received in the event of a successful claim. It should be noted that any amount actually received may be significantly lower than the full claim.
